AN ORDINANCE OF THE COUNTY OF RIVERSIDE AUTHORIZING

THE MORENO VALLEY REDEVELOPMENT AGENCY TO UNDERTAKE

REDEVELOPMENT OF A PORTION OF THE UNINCORPORATED AREA

CONTIGUOUS TO THE CITY OF MORENO VALLEY PURSUANT TO

SECTION 33213 OF THE CALIFORNIA HEALTH AND SAFETY CODE


The Board of Supervisors of the County of Riverside, State of California, Ordains as Follows:

 

Section 1. The City of Moreno Valley has requested that the Board of Supervisors pursuant to Section 33213 of the California Health and Safety Code, designate and authorize the Moreno Valley Redevelopment Agency to undertake the redevelopment of that certain real property located within the territorial limits of the County of Riverside, contiguous to the City of Moreno Valley, more particularly described on Exhibit A, attached hereto. The Board of Supervisors finds that said Section 33213 permits the Board to "authorize the redevelopment of an area within its territorial limits by another community if such area is contiguous to such other community," and determines that the subject properties hereinabove referred to are contiguous to the City of Moreno Valley.

 

Section 2. The Board of Supervisors further finds, pursuant to said Section 33213 that any final redevelopment plan for the project area must be approved by the Board prior to its final adoption by the Redevelopment Agency and the Board requests the submission of additional factual and financial information and data by the Redevelopment Agency prior to the submission of the redevelopment plan to this Board for final approval.

 

Section 3. The City of Moreno Valley and the Moreno Valley Redevelopment Agency are hereby authorized to undertake the redevelopment of the described area in all respects as if the area were within the territorial limits of the City of Moreno Valley except as provided for herein.

 

Section 4. The City Council and Planning Commission of the City of Moreno Valley and the Moreno Valley Redevelopment Agency shall have only those rights, powers and privileges with respect to such area that are necessary for the completion of the proposed redevelopment project.

 

Section 5. The redevelopment project area may include all or any portion of the area described in the attached Exhibit A, and the redevelopment plan for such area shall be approved in accordance with all approvals and findings required by the California Community Redevelopment Law (Sections 33000 et seq. of the California Health and Safety Code).

 

Section 6. As long as the subject property remains unincorporated territory within the County of Riverside, the County of Riverside shall retain all rights, powers and privileges with respect to land use controls and development review, approvals and authorizations for the subject property.

 

Section 7. Prior to the effective date of this ordinance the City of Moreno Valley, the Moreno Valley Redevelopment Agency and the County of Riverside, shall execute an agreement memorializing the requirements and conditions of this ordinance which agreement shall contain provisions indemnifying and holding harmless the County, its officers and agents, from any activities undertaken by the City of Moreno Valley and the Moreno Valley Redevelopment Agency with regard to all redevelopment activities in connection with this proposed redevelopment project.
