Ordinance No. 825

AN ORDINANCE OF THE COUNTY OF RIVERSIDE

REDUCING THE PERMISSIBLE VEHICLE WEIGHT

ON PROSPECT AVENUE IN
THE HIGHGROVE AREA

 

 

            The Board of Supervisors of the County of Riverside do ordain as follows:

Section 1.          Weight Prohibition

            Pursuant to California Vehicle Code Section 35701, any commercial vehicle exceeding a manufacturer’s gross vehicle weight rating of 12,000 pounds is prohibited from using

Prospect Avenue
in the Highgrove area, between
Center Street
on the north and
Citrus Street
on the south.

 

Section 2.          Exemption

            Pursuant to California Vehicle Code Section 35703, this Ordinance does not prohibit any commercial vehicles coming from an unrestricted street having ingress and egress by direct route to and from Prospect Avenue when necessary for the purpose of making pickups or deliveries of goods, wares, and merchandise from or to any building structure located on Prospect Avenue or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure upon Prospect Avenue for which a building permit has previously been obtained.

            Commercial vehicles owned by a public utility or a licensed contractor while necessarily in use in the construction, installation, or repair of any public utility are exempt from the vehicle weight restriction.

 

 

Section 3.          Notice

            Pursuant to California Vehicle Code Section 35701(b), this Ordinance shall not be effective until signs are posted. The Director of Transportation is hereby authorized to post signs indicating that the weight restriction is in effect.

 

Section 4.          Penalty

            Violation of this Ordinance shall be an infraction, punishable by a fine of $100 for the first infraction, a fine of $200 for the second infraction, and a fine of $250 for each additional violation of this Ordinance within a period of one year after the second infraction.
