Ordinance No. 731

ORDINANCE OF THE COUNTY OF RIVERSIDE

ESTABLISHING ADMINISTRATIVE CHARGE FORTHE DEPARTMENT OF

PUBLIC HEALTH/HEALTH SERVICES AGENCY: RETURNED CHECK CHARGE

The Board of Supervisors of the County of Riverside, State of California, Ordains as Follows:

Section 1.  Findings.  The Board of Supervisors finds and determines that:

State law provides for a fee to defray the actual costs incurred by a public agency for a check returned for any reason without payment.  It is necessary to increase the fee as provided below so that the actual cost to the Department of Public Health/Health Services Agency to process and collect returned, unpaid checks may be recovered.

Section 2.  Pursuant to Government Code Section 6157, when a personal check offered in payment pursuant to that section is returned without payment for any reason, a reasonable charge for the returned check not to exceed the actual costs incurred by the agency may be imposed.  The Board of Supervisors authorizes a fee of $20 by the Department of Public Health/Health Services Agency for the processing and collection of returned, unpaid checks.

Section 3.  Effective Date.  This Ordinance shall take effect thirty (30) days from the date of its adoption.
