AN ORDINANCE OF THE
REDUCING THE PERMISSIBLE VEHICLE WEIGHT
IN THE COMMUNITY OF

Section 1. Weight Prohibition
Pursuant to California Vehicle Code Section 35712, any commercial vehicle exceeding a manufacturer’s gross vehicle weight rating of 14,000 pounds is prohibited from using the local streets within the community of Mesa Verde and County Service Area (CSA) 122 as identified in the attached list and map (Exhibit A).
Commercial vehicles exceeding a manufacturer’s gross vehicle weight rating of 14,000 pounds are prohibited from using the following streets:
Bellwood Drive
Blythe Way
Cottonwood Drive
Citrus Drive
Eureka Drive
Evergreen Drive
Green Street
Lemon Drive
Lime Drive
Maple Drive
Mesa Drive, from Bellwood Drive to its southerly terminus
Monroe Drive
Olive Drive
Orange Drive
Orchard Lane
Pallowalla Drive
Pallowalla Road
Park Drive
Pepper Drive
Roses Road
Section 2. Exemption
Pursuant to California Vehicle Code Section 35714, this Ordinance does not prohibit any commercial vehicles coming from an unrestricted street having ingress and egress by direct route to and from the streets within the Mesa Verde community/CSA 122 when necessary for the purpose of making pickups or deliveries of goods, wares, and merchandise from or to any building structure located in the Mesa Verde community/CSA 122 or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure upon roadways in the Mesa Verde community/CSA 122 for which a building permit has previously been obtained.
Commercial vehicles owned by a public utility or a licensed contractor while necessarily in use in the construction, installation, or repair of any public utility are exempt from the vehicle weight restriction.
Section 3. Notice
Pursuant to California Vehicle Code Section 35713, this Ordinance shall not be effective until signs are posted. The Director of Transportation is hereby authorized to post signs indicating that the weight restriction is in effect.
Section 4. Alternate Route
There are currently no streets within the Mesa Verde community/CSA 122 that allow through truck traffic. The route for trucks is the Interstate 10 freeway.
Section 5. Penalty
Violation of this Ordinance shall be an infraction, punishable by a fine of $100 for the first infraction, a fine of $200 for the second infraction, and a fine of $250 for each additional violation of this Ordinance within a period of one year after the second infraction.
Adopted: 846 Item 3.93 of 08/23/2005 per section 3 Ordinance shall not be effective until signs are posted.
