Ordinance No. 804

AN ORDINANCE OF THE COUNTY OF RIVERSIDE BOARD OF SUPERVISORS APPROVING THE REDEVELOPMENT PLAN FOR THE TEMESCAL CANYON PROJECT AREA AND TRANSFERRING REDEVELOPMENT AUTHORITY OF THE UNINCORPORTATED AREAS OF TEMESCAL CANYON TO THE CITY OF CORONA

 

WHEREAS, on July 27, 1999 the County of Riverside (County) and the City of Corona (City) have entered into a Memorandum of Understanding (MOU) for the orderly development and redevelopment of the Temescal Canyon Area (Project Area); and,

WHEREAS, the City has initiated the annexation process (Annexation No. 94) in accordance with the Cortese-Knox Act for the annexation of the Project Area into the City's boundaries; and,

WHEREAS, the City has retained redevelopment authority of the Project Area pursuant to CRL Section 33214; and ,

WHEREAS, the City’s Redevelopment Agency has commenced proceedings to approve the Redevelopment Plan for the Temescal Canyon Project Area to incorporate territory thereunto; and,

WHEREAS, the County wishes to retain and extend the cooperative redevelopment relationship between the City and the County; and,

WHEREAS, CRL Section 33213 permits the County to authorize the redevelopment of an area within its territorial limits by the City if such area is contiguous to the incorporated territory in the City; and,

WHEREAS, those unincorporated portions of the County lying within the boundaries of the Temescal Canyon Project Area, as shown on Exhibit "A" attached hereto and incorporated herein by this reference, are contiguous to incorporated territory in the City of Corona; and,

WHEREAS, the Corona City Council adopted Ordinance No. 2463 on June 21, 2000, approving and adopting the Temescal Canyon Project Area, pursuant to the CRL; and,

WHEREAS, the Redevelopment Agency of the City of Corona, in conjunction with the City of Corona adopted City of Corona Resolution No. 99-01 requesting that the County adopt an ordinance authorizing the City to redevelop an area outside the territorial limits of the city pursuant to CRL Section 33213.

NOW, THEREFORE, THE COUNTY OF RIVERSIDE BOARD OF SUPERVISORS DOES ORDAIN AS FOLLOWS:

 

 

SECTION 1.

That certain document entitled "Redevelopment Plan for the Temescal Canyon Redevelopment Project Area" (the "Redevelopment Plan"), the maps contained therein and such other reports as are incorporated therein by reference, a copy of which is on file at the County Clerk of the Board, having been duly reviewed and considered, are hereby incorporated in this Ordinance by reference and made a part hereof.

SECTION 2.

The Redevelopment Plan is hereby approved as the official Redevelopment Plan for the Project Area.

SECTION 3.

The Board of Supervisors hereby authorizes the City to undertake the redevelopment of the County’ portions of the Project Area prior to annexation.

SECTION 4.

The City Council and the City of Corona Redevelopment Agency shall have all the redevelopment rights, redevelopment powers and redevelopment privileges pursuant to the CRL with respect to the County portions of the Project Area prior to annexation. Upon approval of Annexation No. 94, all City Building and Zoning Codes will become effective with respect to the Project Area.

SECTION 5.

The County Clerk of the Board is hereby directed to send a certified copy of this Ordinance to the City Clerk.

SECTION 6.

This Ordinance shall be in full force and effect thirty (30) days from and after the date of adoption.

SECTION 7.

If any part of this Ordinance or the Redevelopment Plan which it approves is held to be invalid for any reason, such decision shall not affect the validity of the remaining portion of this Ordinance or the Redevelopment Plan, and the Board of Supervisors hereby declares it would have passed the remainder of this Ordinance or approved the remainder of the Redevelopment Plan if such invalid portion thereof had been deleted.

SECTION 8.

The County Clerk of the Board shall certify to the adoption of this Ordinance and cause publication once in a newspaper of general circulation. This Ordinance shall become effective on the 30th day after the date of its adoption.
